By accessing this Site, you accept this Privacy Policy (the “Policy”) and you expressly consent to our use and disclosure of your personal information in the manner described in this Policy. This Policy is incorporated into and subject to the Terms of Use. 

Nylut Directory Services Inc. (“Nylut” or “we” or “our” or “us”) respects your privacy and will only collect, use or disclose your personal information in accordance with this Privacy Policy. We take steps to protect and maintain the confidentiality of personal information of those persons with whom we deal, including users of our Site (collectively “Users” and individually a “User” or “you” or “your, as appropriate).  

We have created this Policy as part of our commitment to helping our users better understand what information we collect about them and what we may do with that information. This Policy explains how we collect, use, disclose, retain and protect your personal information and other information to help us improve your online experience, in particular in connection with your use of our directory services and the Site (the “Service”). 

The Information We Collect. 

We collect personal information you voluntarily provide; for example, when you visit our Site, create an online account with us, use our Services, or contact us or our partners who utilize the Site to provide you with their services. In this Policy, “personal information” means any information that is defined to be personal information under applicable privacy laws and generally refers to facts, together with other information, that can be used to identify an individual. For the purpose of this Policy and your use of the Site, Nylut may obtain the following personal information from you: 

  • contact information such as your name, mailing address, email and telephone number;
  • demographic information such as your ethnicity, age, date of birth and gender; 
  • banking information if required to set up an account on our Site or for payment purposes; 

We will also collect the information that you post to the Site which is intended for public consumption, including, but not limited to, your reviews, tips, photographs, comments, ratings, videos, messages, and votes (the “Public Content”).

In most circumstances, personal information does not include the business contact information of a representative of an organization, such as the representative’s name, position or title, business address, business telephone number or business fax number. Publicly available information, such as information in a public directory, is not personal information under this Policy.

Why Do We Collect Your Personal Information?

We may collect, store, use or disclose the personal information and Public Content you submit to or through the Site for the purposes identified on our Site at the time of collection, as otherwise permitted or required by applicable law, or for any of the following purposes:

  • to provide the Service to you or to allow you to use or access the Site;
  • to comply with our legal obligations and regulatory requirements;
  • to provide information to anyone working with or for us as needed for the provision of the Service;
  • to establish, maintain and manage our relationships with Users of the Service;
  • to respond to your questions and concerns;
  • to detect and protect Nylut and third parties from error, negligence, breach of contract, fraud, theft or other illegal activity, which may include sharing personal information with our insurers and to otherwise communicate with our insurers;
  • to generate, maintain, and utilize (as required to provide the Service) User accounts, if applicable;
  • to generate analytics and statistical data for the purposes of improving our Services; 
  • to help us conduct marketing and advertising; and
  • for any other purpose for which we have obtained your consent.

Why Do We Need Your Consent?

Because you own your personal information, privacy legislation requires that we obtain the consent of an individual for the collection, use or disclosure of personal information in many circumstances. By providing your personal information to us, you agree that we may collect, use and disclose your personal information in accordance with this Policy and as otherwise permitted or required by law, and that we may access, process and store your personal information in Canada or another jurisdiction.

When we receive personal information from you for the purposes of providing you with the Service, or for other uses identified herein, you are providing us with consent as follows:

  • to allow us to provide your personal information to third parties that we engage to provide or support the Service.

If you need to provide us with personal information about other individuals, you represent and warrant to us that, where required by law and prior to your disclosure to us, you will obtain the consent of each individual to the collection, use and disclosure by us for the specific purpose(s) that the disclosure is made by you.

There are legal exceptions where we will not need to obtain consent or explain the purposes for the collection, use or disclosure of personal information. Some examples of situations where consent is not required include an emergency that threatens the life, health or security of an individual, or if we must comply with a court order or governmental order.

Children and Consent

The Site is not directed to persons under 13. If a parent or guardian becomes aware that his or her child has provided us with personal information without their consent, he or she should contact us. We do not knowingly collect personal information from children under 13. If we become aware that a child under 13 has provided us with their personal information, we will delete such information from our system.

What Information Do We Collect and How Do We Use It?

Providing us with your personal information is always your choice. When you utilize our Service or use or access our Site, we may ask that you provide information that enables us to respond to your request and/or provide you with our Service. In doing so, you consent to our collection, use and disclosure to appropriate third parties of such personal information for these purposes.  

We will only collect personal information that is deemed necessary to provide you with the Service or improve our Site and will use your personal information in accordance with this Policy. If in the course of managing our business operations, we share your personal information with professional advisors, merchants, contractors or suppliers, any such individuals or entities shall be required to comply with privacy guidelines that impose obligations at least commensurate with this Policy. If we sell our organization or merge with another party, your consent will be implied to transfer your information to our successor for the same purposes as set out in this Policy.

We do not sell your personal information to third parties under any circumstances and we only use your personal information in compliance with this Policy and as required to satisfy any law, regulation, legal request, to protect our business interests, and to co-operate with any law enforcement investigation or on matters concerning public policy and safety.

Use of Cookies

Nylut may occasionally use cookies to track how its visitors use the Site or to determine your browsing preferences. Cookies help us to improve our Site and provide you with better and more personalized Service. The Site will notify you before any cookies are used, so that you may refuse or customize them. 

Our Site also uses Adobe Analytics, provided by Adobe Inc. (“Adobe”). We use Adobe Analytics to help us measure performance of the Site, to provide you with improved and more personalized experience, and in some cases, to tailor ads to your likely interests. As with other providers of analytics services, Adobe Analytics uses cookies to provide us with information and functionality. Your Rights over Your Information

We recognize that you may wish to access your personal information or request a correction, deletion or addition of information. We will attempt to accommodate such requests to the extent possible provided we still have access to the information. If we are unable to provide you with the requested information or complete your request, we will notify you in writing of receiving your written request and explain our reason(s) for not fulfilling your request 

Your Responsibility

You are responsible for all actions taken with your login information and password if you have an account with us. We do not recommend that you disclose your Site password or login information to any third party. If you choose to share this information with anyone, you are responsible for all actions taken with your login information, account profile and personal information. 

Third Party Vendors

We may share personal information with third party vendors who need to know such personal information in order to provide their services to us, or to provide their services to customers. This group includes vendors that help us provide our Services such as:

  • Payment providers that process your credit and debit card information,
  • Fraud prevention services that allow us to analyze fraudulent payment transactions,
  • Postal and email delivery services that help us stay in touch with the user,
  • Customer chat and email support services that help us communicate with any person,
  • those that assist us with our marketing efforts (e.g. by providing tools for identifying a specific marketing target group or improving our marketing campaigns),
  • Vendors who have business accounts with us and provide services or sell products on or through our Site where such information is required by them to provide you with their services;
  • those that help us understand and enhance our Services, and companies who may need information about you in order to provide technical or other support services to you.

We require vendors to agree to privacy commitments in order to share information with them.

The Site may contain links to other websites operated by third parties. Please note that this Policy applies only to the personal information that we collect or receive from you with your consent and we cannot be responsible for personal information that third parties may collect, store and use, including through their websites. Changes to this Privacy Policy

We may change this Policy from time to time with no notice. Laws, regulations and industry standards evolve, which may make such changes necessary, or we may make changes to our business model. We encourage you to review our Policy regularly in order to stay informed. If we make changes that materially alter your privacy rights, we will provide additional notice, such as via email or through the Site. We will indicate at the top of this document the date that changes were last made and any revisions will take effect upon posting.

Security, retention and destruction of personal information 

We take all reasonable steps to protect the security and confidentiality of your personal information, We protect the personal information within our custody or control with appropriate organization, technological and physical safeguards.

We store personal information in electronic files that are secure, and our security measures include secure on- and off-site storage, restricted access to records and data processing equipment, password protocols and encryption and security software. 

The amount of time we will retain personal information varies, depending on the Services you have accessed on or through our Site and the nature of the personal information that we hold. Except you instruct us in writing to delete your personal information, we retain personal information for such period of time as is necessary for us to maintain sufficient information so we may respond to any issues that arise at a later date or as is required by law.

When personal information is no longer required by us or by law, we will either convert it into an aggregated non-identifying form or we will appropriately destroy or erase the personal information in a manner that is in accordance with our current policies and procedures.

Electronic Communications

We endeavor to comply with Canada’s Anti-Spam laws (“CASL”) in our commercial electronic communication and software downloads with you. Should you fail to provide us with the requisite consent to send you commercial electronic messages or download software, or withdraw such consent, we may be unable to provide some of our Services that can only be provided if we receive appropriate and required personal information and your CASL consent. 

By providing us with your e-mail address, you agree that we may communicate with you electronically and we may send promotional messages to you. You may provide, withdraw or modify your CASL consent by notifying us at the address below. You may also unsubscribe at any time from receiving commercial electronic messages by following the instructions in the message.

Even if you have opted out of receiving marketing communications from us, please be aware that we may still contact you for other purposes. For example, we may contact you to provide communications you have consented to receive, regarding the Services we provide to you, or if you contact us with an inquiry.
